New Delhi: The Supreme Court has clarified that there is no stay on the SIR proceedings in Kerala. Issuing a notice to the Election Commission, the Court scheduled the petitions for detailed consideration on the 26th.
When the Kerala government highlighted the ongoing local body elections in the state, the Court noted that the Kerala-related petitions would be examined separately. The matter was heard by a three-judge bench led by Justice Suryakant, which is also handling the SIR petitions from Bihar. Senior advocate Kapil Sibal appeared on behalf of the Kerala government.
The state government had approached the Supreme Court seeking a temporary halt to the SIR process due to the election period. However, parties including the Muslim League, Congress, CPM, and CPI argued that the SIR itself is unconstitutional. Earlier, while dealing with the Bihar SIR petitions, the Court had not accepted similar pleas but had sought a stay.
